The dispute

A tenant alleged extensive construction defects across a recently completed commercial fitout. The builder contended that many items were design-driven or arose from poor post-handover maintenance. A construction expert witness report was required to allocate responsibility item by item.

Matter: Tenant fitout dispute, South Australian Magistrates Court

Our expert's findings

Each defect item was assessed against the contract documents, approved design and applicable standards. A Scott Schedule allocated cause to workmanship, design or maintenance, with quantum bands. Approximately half the items were workmanship-related; the remainder were either design choices accepted by the principal or maintenance issues post-handover.

Outcome

Clear allocation enabled a structured negotiation. The matter resolved without trial, with the builder rectifying the workmanship-related items and the principal accepting the design and maintenance items.
